These Terms and Conditions ("Terms") govern your use of the website phantastiq.ca and the services provided by Phantastiq ("we," "us," "our"). By accessing our website, purchasing our services, or communicating with us, you agree to be bound by these Terms.
Phantastiq provides AI-powered content production services for businesses, including AI-generated social media content (video, image, and text), automated publishing to social media platforms, ongoing content management and optimization through monthly retainer plans, self-paced and guided training courses, and related consulting and strategy services.
One-Time Build: A one-time fee of $5,000 CAD for the initial setup, configuration, and deployment of your AI content employee. This includes a complimentary 90-day retainer period beginning on the date of deployment.
Monthly Retainer Plans: Following the 90-day complimentary period, continued service requires an active retainer subscription. Plans are billed monthly or annually as selected at the time of enrollment. Current pricing and tier details are available upon request and may be updated from time to time.
Subscription Plans: Monthly subscription plans are available as an alternative to the full build, starting at $497/month CAD.
Courses: Self-paced course ($997 CAD) and guided course with live build session ($1,997 CAD). Course fees are credited toward the full $5,000 build if you choose to upgrade.
All prices are in Canadian dollars and are subject to applicable taxes.
Payments are processed securely through Stripe. By providing your payment information, you authorize us to charge the applicable fees to your designated payment method.
For recurring subscriptions and retainers, your payment method will be automatically charged at the beginning of each billing cycle (monthly or annually). You will receive a notification prior to the end of any complimentary or trial period before charges begin.
All fees are non-refundable except as expressly stated in these Terms or as required by applicable law.
The 90-day complimentary retainer period begins on the date your AI content employee is deployed. At the end of this period, your selected retainer plan will automatically activate and your payment method on file will be charged. You will receive advance notice before charges begin.
If you choose not to continue with a retainer plan, you must notify us before the end of the 90-day period. Your AI content employee will be deactivated upon expiry if no retainer is active.
Monthly retainers and subscriptions: You may cancel at any time. Cancellation takes effect at the end of your current billing period. No partial refunds are provided for unused portions of a billing period.
Annual retainers: You may cancel at any time. No refunds are provided for the remaining portion of the annual term.
One-Time Build: The $5,000 build fee is non-refundable once work has commenced. If you cancel before work begins, a full refund will be issued.
Courses: Course fees are non-refundable once access has been granted.

You consent to receive SMS messages from Phantastiq related to service updates, performance reports, account notifications, and promotional offers.
Message frequency may vary but will not exceed approximately 8 messages per month.

You may opt out at any time by replying STOP to any message. You may also opt out by emailing hello@phantastiq.ca.
Your mobile number will not be sold, rented, or shared with third parties for their marketing purposes.
To resume messages after opting out, reply START or contact us directly.

Content we create for you: All content created by Phantastiq as part of your build or retainer (including videos, images, captions, and graphics) is owned by you upon delivery and full payment of applicable fees. You grant Phantastiq a non-exclusive, royalty-free license to use samples of this content for portfolio, case study, and promotional purposes, unless you notify us otherwise in writing.
Our intellectual property: All Phantastiq systems, workflows, templates, tools, branding, the Luna Score system, and proprietary technology remain the exclusive property of Phantastiq. Your subscription or retainer grants you a license to use these systems for the duration of your active service. This license terminates upon cancellation.
AI-generated content: Content produced by our services is generated using third-party AI models. We make reasonable efforts to ensure quality and originality but cannot guarantee that AI-generated content is free from similarity to other content. You are responsible for reviewing all content before publishing.
By using our services, you grant Phantastiq the right to collect, aggregate, and anonymize performance data and metadata generated through your use of our services. This anonymized, aggregated data may be used for industry benchmarking, product improvement, research, and development purposes. This data will not identify you or your business. See our Privacy Policy for full details.
You agree to provide accurate and complete information about your business, brand, and content preferences. You are responsible for reviewing and approving content before it is published to your social media accounts (where applicable based on your service tier). You will maintain the necessary social media accounts and access permissions required for our services to operate. You will not use our services for any unlawful, fraudulent, or harmful purpose.
We strive to provide uninterrupted service but do not guarantee that our services will be available at all times. Service may be temporarily interrupted for maintenance, updates, or circumstances beyond our control, including third-party platform outages (Instagram, TikTok, etc.) and AI model provider disruptions.
We are not liable for any losses arising from temporary service interruptions.
To the maximum extent permitted by law, Phantastiq's total liability for any claim arising from or related to our services is limited to the total fees you have paid to us in the 3 months preceding the claim.
We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost revenue, or lost business opportunities, even if we have been advised of the possibility of such damages.
We do not guarantee specific results, including follower growth, engagement rates, revenue, or leads, from the use of our services.
You agree to indemnify and hold harmless Phantastiq, its officers, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from your use of our services, your breach of these Terms, or your violation of any third-party rights.
Phantastiq offers a referral program. Credits are applied to your account as follows: 1 referral = $500 credit, 3 referrals = $1,500 credit, 5 referrals = free AI employee build. Credits are stackable and may be applied to future services. Credits are not redeemable for cash. Referred clients receive 10% off their first purchase. Full referral program details are available upon request.
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms. For material changes, we will notify you via email or SMS.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or our services shall be resolved in the courts of Ontario.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
